ArtifactPilot End User License Agreement

This End User License Agreement ("Agreement") governs your installation and use of ArtifactPilot. By installing, activating, or using ArtifactPilot, you agree to this Agreement. If you do not agree, do not install, activate, or use the Software.
This Agreement is written for a commercial Windows desktop software product. It is not legal advice to you, and it does not replace any mandatory rights you may have under applicable law.
1. Definitions
1.1 "ArtifactPilot" or "Software" means the ArtifactPilot Windows desktop application, installer, executable files, documentation, configuration files, update metadata, license tools, icons, and related materials supplied by NH Media LLC.
1.2 "Licensor," "we," "us," or "our" means NH Media LLC.
1.3 "User," "you," or "your" means the person or organization installing, activating, purchasing, subscribing to, or using ArtifactPilot.
1.4 "Checkout Provider" means the payment, merchant-of-record, subscription, customer-portal, and licensing platform used to sell or deliver ArtifactPilot. The current checkout and merchant-of-record provider is Lemon Squeezy unless a checkout page, receipt, or written agreement identifies a different provider.
1.5 "License Key" means the unique activation key, subscription-linked license, purchase code, or other credential issued for ArtifactPilot through NH Media LLC or the Checkout Provider.
2. License Grant
Subject to this Agreement, payment terms, license status, and any activation limits stated at checkout, NH Media LLC grants you a limited, revocable, non-exclusive, non-transferable license to install and use ArtifactPilot for your own developer workspace cleanup workflow.
Unless the checkout page or written agreement states otherwise, an individual license is for one user and up to two activations, meaning up to two active device activations. Team, business, or enterprise terms may be offered separately.
3. Trial Mode and Fully Licensed Mode
ArtifactPilot may offer a time-limited Trial Mode. Trial Mode is intended to let users scan workspaces, inspect candidates, view Scan Analysis, and preview scan customization before purchasing.
Unless a different period is stated in the app or on the product page, Trial Mode lasts 14 calendar days from first use on the device. When Trial Mode ends, ArtifactPilot may require activation before continued use.
Fully Licensed mode requires a valid active License Key or subscription. Licensed features may include cleanup, report export, saved workspaces, saved custom targets, exclusions, production license validation, and advanced scan-setting changes.
4. Subscriptions, Activation, and License Validation
ArtifactPilot may use online license activation and validation through Lemon Squeezy or another Checkout Provider. A License Key may be associated with a subscription, order, activation instance, customer email, activation limit, plan/variant, product identifier, variant identifier, and pseudonymous machine identifier.
The pseudonymous machine identifier is generated locally as a one-way cryptographic hash of basic device and operating-system attributes. It is not generated by scanning source code, project contents, personal files, or cleanup candidates, and it is used to support activation limits and license validation.
If your subscription expires, is canceled after the paid period ends, is refunded, is charged back, or is disabled by the Checkout Provider or NH Media LLC, ArtifactPilot may return to Trial Mode, activation-required mode, or license-validation-required mode.
Do not share, resell, publish, sublicense, or distribute License Keys. NH Media LLC may revoke or disable licenses obtained through fraud, chargeback abuse, unauthorized resale, credential sharing, payment failure, or violation of this Agreement.
5. Review-First Cleanup Model
ArtifactPilot is a review-first cleanup assistant for developer workspaces. Scanning is read-only. Cleanup requires user selection, a final dry-run preview, and user approval before ArtifactPilot requests that approved items be moved.
ArtifactPilot is designed to move approved items to the operating system Recycle Bin or Trash when the operating system can safely do so. ArtifactPilot does not provide a normal permanent-delete mode. Operating-system Recycle Bin or Trash behavior can vary by drive, file size, policy, permissions, long paths, and system configuration.
You are responsible for reviewing scan results, paths, risk labels, warnings, dry-run previews, and operating-system prompts before approving cleanup.
6. No Data-Recovery Guarantee
ArtifactPilot is intended to identify rebuildable developer artifacts such as dependency folders, generated caches, build output, framework artifacts, temporary project artifacts, reports, and similar cleanup candidates. It is not a backup, version-control, forensic, data-recovery, or storage-management guarantee.
Before approving cleanup, you should ensure your important work is backed up and committed to version control where appropriate.
7. Restrictions
You may not reverse engineer, modify, bypass licensing, remove notices, redistribute, resell, sublicense, rent, lease, host, or provide ArtifactPilot as a service except as expressly permitted by NH Media LLC in writing or by applicable open-source license terms for third-party components.
You may not use ArtifactPilot to violate law, remove evidence, hide wrongdoing, bypass employer policy, damage systems, or clean files that you do not have authority to manage.
8. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless NH Media LLC, its owners, officers, employees, contractors, licensors, service providers, and affiliates from and against claims, losses, liabilities, damages, judgments, settlements, costs, and expenses, including reasonable attorneys' fees, arising from or related to your unauthorized use of ArtifactPilot, violation of this Agreement, violation of law or policy, misuse of cleanup functionality, or cleanup of systems, workspaces, files, or accounts that you did not have authority to manage.
9. Updates
ArtifactPilot may check a public update manifest or direct you to the ArtifactPilot website to download updates. Updates may change features, pricing, licensing behavior, scan rules, documentation, or supported platforms. You are responsible for reviewing any updated terms that apply to an update.
10. Third-Party Services
Payment processing, subscription billing, sales-tax/VAT handling, license delivery, customer portals, refunds, chargebacks, and receipts are handled through the Checkout Provider when you purchase ArtifactPilot through that provider. Those services are governed by their own terms and privacy policies. NH Media LLC remains the developer and publisher of ArtifactPilot and provides product support according to the support policy.
11. Support and Refunds
Support and refunds are governed by the ArtifactPilot Support and Refund Policy, the checkout terms, the Checkout Provider's rules, and mandatory law. If those terms conflict, mandatory law and the Checkout Provider's required process may control the transaction.
12. Ownership
ArtifactPilot is licensed, not sold. NH Media LLC and its licensors retain all rights not expressly granted in this Agreement.
13. Privacy
ArtifactPilot's data handling is described in the ArtifactPilot Privacy and Data Handling Notice. Local logs, scan reports, cleanup manifests, and support bundles may contain local file paths and should be treated as potentially sensitive.
14. WARRANTY DISCLAIMER
ARTIFACTPILOT IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. NH MEDIA LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED OPERATION, ERROR-FREE OPERATION, AND DATA RECOVERY.
15. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NH MEDIA LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY, OR LOST-PROFIT DAMAGES, OR FOR LOSS OF DATA, LOSS OF BUSINESS, LOSS OF GOODWILL, COMPUTER DOWNTIME, LOST PRODUCTIVITY, LOST OPPORTUNITY, OR COST OF SUBSTITUTE SERVICES ARISING FROM ARTIFACTPILOT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NH MEDIA LLC'S AGGREGATE LIABILITY RELATED TO ARTIFACTPILOT WILL NOT EXCEED THE AMOUNT YOU PAID FOR ARTIFACTPILOT DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
16. Termination
This Agreement remains in effect until terminated. Your license terminates automatically if you violate this Agreement, fail to maintain an active subscription where required, or use a revoked, refunded, disabled, or unauthorized license. After termination, you must stop using ArtifactPilot and uninstall it.
17. Governing Law
This Agreement is governed by the laws of the State of Texas, excluding conflict-of-law rules, unless mandatory law requires otherwise.
To the maximum extent permitted by law, any dispute, claim, or proceeding arising from or relating to ArtifactPilot or this Agreement must be brought exclusively in the state courts located in Dallas County, Texas, or in the United States District Court for the Northern District of Texas, Dallas Division. You and NH Media LLC consent to personal jurisdiction and venue in those courts and waive objections based on inconvenient forum, except where mandatory law gives you a non-waivable right to bring a claim elsewhere.
18. Third-Party and Open-Source Software
ArtifactPilot includes, bundles, calls, or is built with third-party and open-source software components, libraries, runtimes, installer systems, signing services, licensing services, and operating-system APIs. These components are governed by their respective licenses and terms, which are included or referenced in THIRD_PARTY_NOTICES.txt, the documentation, or the component provider's materials. Nothing in this Agreement restricts any rights you may have under applicable open-source licenses for those components.
19. General Terms
If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. This Agreement, the ArtifactPilot Privacy and Data Handling Notice, the ArtifactPilot Support and Refund Policy, the Third-Party Notices, and any applicable checkout terms constitute the entire agreement between you and NH Media LLC regarding ArtifactPilot, except for any separate written agreement signed or accepted by NH Media LLC.
NH Media LLC's failure to enforce a provision of this Agreement is not a waiver of that provision or of any other provision.
